New model to determine lifetime spending

Jan. 30, 2013 ? University of Virginia Darden School of Business research shows new, more effective ways to plan for retirement.

Every day, financial planners help future retirees determine how much they'll spend or "consume" each year of their lifetime. The answer lets individuals know how much they'll need to save to live comfortably. However, making plans without knowing how long you will live is a financial challenge. As the saying goes, "You can't take it with you when you die." At the same time, individuals do not want to outlive their retirement savings.

Darden Professors Samuel E. Bodily, John Tyler Professor of Business Administration, and Assistant Professor Casey Lichtendahl discussed what they believe to be a more effective preference model for the financial-planning problem in their award-winning research paper, "Preferences for Consumption Streams: Scale Invariance, Correlation Aversion and Delay Aversion Under Mortality Risk."

The professors demonstrate that people should put their money where their health is.

"People tend to 'under plan,'" said Bodily. "They plan to spend less at 65 years of age and spend more money when they are in their 80s. With this type of spending delay, individuals risk not getting to spend as much as they might like during their lifetimes."

To better determine consumption habits, a small but growing number of financial planners offer computer-based forecasting tools. The tools ask individuals to enter information about financial obligations, savings and assets. These "financial planning calculators" generate reports that guide individuals and their planners as they choose the best approach for growing retirement savings based on consumption during each phase of a retiree's life.

Bodily and Lichtendahl favor this approach, but identify one pitfall: The common financial model, which takes additive preferences into account, fails to address dependencies on uncertainties. It doesn't distinguish between situations in which consumption is all bad or all good versus situations in which there are some bad and some good years. Instead, the researchers developed the multiplicative-expo power utility (MEP), which accounts for risks and uncertainties. Using MEP can help financial planners better forecast their clients' retirement spending needs.

Past lab experiments that studied consumption preferences showed that most people are "correlation averse," meaning they prefer to have a mixture of bad and good years rather than all bad or all good years. One positive effect of using MEP is that it suggests that retirees spend more in their early retirement years when they are more likely to be healthy and able to consume more rather than later.

"We're taking raw preferences of individuals and using the information to make decisions about spending," said Lichtendahl. "This model has important implications for how planners and analysts advise individuals planning for retirement."

"With MEP, you can solve dynamic problems because you can take them apart in time," Bodily added. "The MEP form is general and can also help with decisions such as career choices, investment choices and insurance planning."

Earlier in the fall, they were chosen as finalists for the 2012 Decision Analysis Publication Award. The prize recognizes the best 2010 publication in "decision analysis, broadly defined." The members of the 2012 Publication Award Committee chose their work because it offered a significant impact on decision-making and business practice. Their research was published in the journal Operations Research. Bodily and Lichtendahl were recognized at the conference of the Institute for Operations Research and the Management Sciences for receiving the award.

Last month, Bodily and Lichtendahl won the "Best Paper" Decision Analysis Special Recognition Award for their December 2012 paper in Decision Analysis on "Multiplicative Utilities for Health and Consumption." This paper builds upon the use of multiplicative utilities such as MEP to connect consumption habits with health status and future health considerations.

Bodily researches decision and risk analysis, strategy modeling and analysis, forecasting and lifetime consumption, and investment planning. He has written several books, a wide variety of journal articles in publications including Operations Research and Harvard Business Review and more than 120 cases and technical notes on quantitative analytics.

Lichtendahl teaches Quantitative Analysis courses in Darden's MBA program. His research focuses on eliciting, evaluating and combining probability forecasts for use in corporate and governmental decision-making situations. His other research interests include modeling consumption preferences for use in personal financial decisions.

In addition to advancing knowledge in the area of decision analysis and modeling, Bodily and Lichtendahl hope to modernize the way financial planners and wealth managers help individuals shape the quality of their older adult lives through more effective planning for retirement.

(AP) ? Troubles surrounding the Broadway musical "Rebecca" have snared the show's publicist.

The show's producers sued Marc Thibodeau in New York State Supreme Court on Tuesday, claiming defamation and breach of contract and fiduciary duty.

They say Thibodeau sent emails discouraging a possible investor from putting $2.25 million into the show. Thibodeau also represented "The Phantom of the Opera" for 25 years.

Thibodeau's lawyer, Jeffrey Lichtman, tells The New York Times (http://nyti.ms/116f5Dp ) that his client was an "innocent whistle-blower."

The producers also sued Long Island securities dealer Mark Hotton in October. He is criminally charged with pretending to raise millions from investors in return for a commission and travel expenses.

Hotton's lawyer has said his client didn't set out to defraud the show.

The show is on hold indefinitely.

How to OTA (over-the-air) update to iOS 6.1 on your iPhone, iPad, and iPod touch

Apple released iOS 6.1 to the public yesterday which includes the ability to buy movie tickets with Siri, better LTE support, and more. Since the introduction of iOS 5, Apple has allowed us to update our iPhones, iPads, and iPod touches over-the-air instead of having to plug into iTunes.

Normally your iPhone, iPad, or iPod touch will alert you when an update is ready, but if it hasn't, we can walk you through how to manually trigger the over-the-air update.

Note: Apple requires your battery to be at 50% or better in order to install a software update over-the-air without being plugged into a charger.

  1. Make sure you have your iCloud password on hand. This update is different from previous ones and will ask you to provide your iCloud password upon completing the update. Make sure you have and know that before proceeding any further.
  2. Launch the Settings app from the Home screen of your iPhone, iPad, or iPod touch.
  3. Tap on General.
  4. Now tap on Software update.
  5. Your iPhone, iPad, or iPod touch will check to see if there's an update available.
  6. You'll either have the option to Download and Install or Install Now if you're device has already downloaded the software. Tap on it.
  7. You may be prompted to plug your device in to save battery. Just tap Continue.
  8. Let your iPhone, iPad, or iPod touch do its thing. It'll reboot and once it does, you should now be on the newest software version.

Satellite visualization tool for high-resolution observation review (thor) accessible from any location with internet access

Jan. 29, 2013 ? A paper published in the February issue of Computers & Geosciences, describes a case study in which an Earth-observing satellite tool, the Tool for High-Resolution Observation Review (THOR), using minimal coding effort, is converted into a practical web-based application, THOR-Online. In addition, a 3D visualization technique is also described in this paper.

Initially only operable from a desktop computer, with the approach outlined in the study, THOR is now accessible online from NASA's Precipitation Processing System website. This allows researchers to remotely examine the 15-year archive of Tropical Rainfall Measuring Mission (TRMM) satellite data. Efforts to improve THOR have been on-going since the 1997 launch of Tropical Rainfall Measuring Mission (TRMM) satellite, which carries first space-borne radar capable of observing detailed three-dimensional structure of regions of precipitation inside of storm clouds.

"The 3D display technique can be used to make features of, for example, a hurricane, visually accessible even to those without technical training in meteorology," explained Owen Kelley, author of the study. "The TRMM satellite observed Hurricane Sandy a day before its U.S. landfall affecting New Jersey and New York, among other states. Using this technique, TRMM 3D images of the storm's overflight and other tropical cyclones during the final months of 2012 could be made available through NASA Hurricane Resource Page."

"Addressing an important problem at intersection of the geosciences (remote sensing, hydrology, meteorology) and computer sciences, this article is a poster child example of what we aim to publish in Computers & Geosciences," explains Jef Caers Co-Editor-in-Chief of Computers & Geosciences. "It uses modern computer science paradigms such as the World Wide Web, code re-use and practical graphical user interfaces to address an important geoscience problem."

The approach outlined in the paper may be of interest to other organizations responsible for earth-observing satellites that have custom desktop visualization tools which may need to be converted to online applications for broader usage, or that have 3D datasets that require the development of an interactive visualization tool.

Chastened Congress takes on immigration

WASHINGTON (AP) ? A bipartisan group of leading senators has reached agreement on the principles for a sweeping overhaul of the nation's immigration laws, including a path to citizenship for the 11 million illegal immigrants already in this country.

The deal, to be announced at a news conference Monday, also covers border security, non-citizen or "guest" workers and employer verification of immigration status.

Although thorny details remain to be negotiated and success is far from certain ? the legislation could run into trouble in the Republican-controlled House ? the development heralds the start of what could be the most significant effort in years toward overhauling the nation's inefficient patchwork of immigration laws.

President Barack Obama also is committed to enacting comprehensive immigration legislation and will travel to Nevada on Tuesday to lay out his vision, which is expected to overlap in important ways with the Senate effort.

The eight senators expected to endorse the new principles Monday are Democrats Charles Schumer of New York, Dick Durbin of Illinois, Robert Menendez of New Jersey and Michael Bennet of Colorado; and Republicans John McCain of Arizona, Lindsey Graham of South Carolina, Marco Rubio of Florida and Jeff Flake of Arizona.

Several of these lawmakers have worked for years on the issue. McCain collaborated with the late Democratic Sen. Edward M. Kennedy on comprehensive immigration legislation pushed by then-President George W. Bush in 2007, only to see it collapse in the Senate when it couldn't get enough GOP support.

Now, with some Republicans chastened by the November elections which demonstrated the importance of Latino voters and their increasing commitment to Democrats, some in the GOP say this time will be different.

"What's changed, honestly, is that there is a new, I think, appreciation on both sides of the aisle ? including maybe more importantly on the Republican side of the aisle ? that we have to enact a comprehensive immigration reform bill," McCain said Sunday on ABC's "This Week."

"I think the time is right," McCain said.

The group claims a notable newcomer in Rubio, a potential 2016 presidential candidate whose conservative bona fides may help smooth the way for support among conservatives wary of anything that smacks of amnesty. In an opinion piece published Sunday in the Las Vegas Review-Journal, Rubio wrote that the existing system amounts to "de facto amnesty," and he called for "commonsense reform."

According to documents obtained by The Associated Press, the senators will call for accomplishing four goals:

?Creating a path to citizenship for illegal immigrants already here, contingent upon securing the border and better tracking of people here on visas.

?Reforming the legal immigration system, including awarding green cards to immigrants who obtain advanced degrees in science, math, technology or engineering from an American university.

?Creating an effective employment verification system to ensure that employers do not hire illegal immigrants.

?Allowing more low-skill workers into the country and allowing employers to hire immigrants if they can demonstrate they couldn't recruit a U.S. citizen; and establishing an agricultural worker program.

The principles being released Monday are outlined on just over four pages, leaving plenty of details left to fill in. What the senators do call for is similar to Obama's goals and some past efforts by Democrats and Republicans, since there's wide agreement in identifying problems with the current immigration system. The most difficult disagreement is likely to arise over how to accomplish the path to citizenship.

In order to satisfy the concerns of Rubio and other Republicans, the senators are calling for the completion of steps on border security and oversight of those here on visas before taking major steps forward on the path to citizenship.

Even then, those here illegally would have to qualify for a "probationary legal status" that would allow them to live and work here ? but not qualify for federal benefits ? before being able to apply for permanent residency. Once they are allowed to apply they would do so behind everyone else already in line for a green card within the current immigration system.

That could be a highly cumbersome process, but how to make it more workable is being left to future negotiations. The senators envision a more streamlined process toward citizenship for immigrants brought here as children by their parents, and for agricultural workers.

The American Civil Liberties Union said in a statement that the framework agreed on by the senators could provide important protections for illegal immigrants who are exploited by employers and live in "constant fear" over their immigration status.

But the ACLU took issue with the proposal to require employers to use an electronic employment-verification system, calling it "a thinly disguised national ID requirement" that would undermine employees' privacy and lead to discrimination against those "who look or sound 'foreign.'"

Such legislation could also face long odds in the House, which is dominated by conservative Republicans and which has shown little interest in immigration reform.

The debate will play out at the start of Obama's second term, as he aims to spend the political capital afforded him by his re-election victory on an issue that has eluded past presidents and stymied him during his first term despite his promises to the Latino community to act.

"As the president has made clear for some time, immigration reform is an important priority and he is pleased that progress is being made with bipartisan support," a White House spokesman, Clark Stevens, said in a statement. "At the same time, he will not be satisfied until there is meaningful reform and he will continue to urge Congress to act until that is achieved."

For Republicans, the November elections were a stark schooling on the importance of Latino voters, who voted for Obama over Republican Mitt Romney 71 percent to 27 percent, helping ensure Obama's victory. That led some Republican leaders to conclude that supporting immigration reform with a path to citizenship has become a political imperative.

Leaders of large organizations cannot meet regularly with every employee to reinforce important points. So a CEO needs to take creative steps to communicate to a far-flung workforce.

At Chipotle, the burrito chain, founder and co-CEO Steve Ells sends messages through multiple channels. He designs each restaurant to maximize interaction between customer and food preparer, which re??minds employees to connect with each visitor and deliver personal service.

As people give their order, employees maintain eye contact and rarely turn their backs. In competing fast-food joints, by contrast, employees often turn and walk away from the customer after taking an order.

Similarly, Ells commu?nicates the im??portance of serving fresh food by positioning his employees behind the counter grilling meat and stirring rice. Customers can see their dishes being prepared; if they order guacamole, employees are trained to say something like, ?It?s a good batch. I just made it.?

To convey the value of quality ingredients, Ells takes a minimalist ap??proach. He communicates powerful messages with few words. For example, he told managers that ?Chipotle was eliminating onion-?cutting machines in favor of having staffers cut each onion by hand. They knew this would be more time-?consuming, but Ells simply said, ?It tastes better.?

Ells faced a different kind of communication challenge in 2011 when he wanted the public to know Chipotle buys vegetables from local farms and supports sustainability in other ways.

So he commissioned a two-minute film called ?Back to the Start? to air on television during the Grammy Awards.

The story follows a farmer doing business locally. It contains no speaking, and the only promotion of Chipotle is as it ends?when the word appears on the side of a delivery truck. Viewers learn of Chipotle?s devotion to buying from local farms without feeling subjected to a preachy commercial.

Rare 1794 silver dollar auctioned for record $10M

A 1794 silver dollar, which many experts believe was the first such coin struck by the U.S. Mint, sold for a record $10 million at auction on Thursday.?

The Flowing Hair Silver Dollar more than doubled the previous $4.1 million auction?record for a coin set in 1999, auction house Stack's Bowers Galleries said.?

Legend Numismatics, a rare-coin firm based in New Jersey, bought the coin, which was the highlight of the evening sale in New York that fetched a total of $17.2 million.?

"We felt in our heart that this would be the very first coin to exceed the $10 million barrier in auction and were in fact prepared to bid much high in order to acquire this unique piece of history," the company said in a statement, adding it had no plans to sell the coin in the near future.?

David Bowers, chairman emeritus of Stack's Bowers Galleries, said the coin has unique features that make it particularly valuable.?

"It is the first American metal dollar struck and the finest known. You have these combinations coming together. No museum has an equal piece," he told Reuters.?

The coin was part of the Cardinal Collection, amassed by the collector Martin Logies. Bowers described the collection as the "Old Masters" of coins struck during the earliest years of the U.S. Mint.?

"I think it is extraordinary and I am very pleased that the first silver dollar is the first to top the $10 million threshold," said Logies, who purchased the coin three years ago.?

The $10 million price includes the buyer's commission.?

Like the buoyant art market, which is expecting another good year in 2013, Bowers said coins are a good investment, have a worldwide market and have risen steadily in value.?

"We're continually surprised by surprises," he said, adding there are several million coin collectors around the globe. "They want to collect coins for appreciation, art, rarity and beauty."?

The record-setting coin shows a profile of Miss Liberty facing right surrounded by stars representing each state in the union. The design was only used in 1794 and briefly the following year.?

Another top seller in the sale of 94 lots was the 1792 Half Disme, which dates back to David Rittenhouse, the first director of the U.S. Mint. It fetched $975,000, excluding the 17.5 percent buyer's commission.?

When starting a new venture, entrepreneurs face a number of choices. These range from picking the right name to selecting the right talent to join the team. These questions are critical and should be addressed with the utmost care and deliberation, as they can make or break a business. One other choice faced by an entrepreneur that wants to offer a product or service and make a difference is whether to create a non-profit or for-profit. This is a choice especially difficult for social entrepreneurs ? people that want to combine profit and purpose.

While it?s worth thinking about because of the legal distinctions and consequences of selecting either, the choice between for-profit and non-profit is not as important as it used to be as more non-profits generate income from business activities that go back to support the core charitable programs, and for-profits build giving back into their corporate mission.

Two local examples illustrate how a non-profit organization can blend in aspects of a traditional for-profit business. Food For Life?s core mission is to help train young adults in culinary arts and equip them with life skills, but it also sells the meals that the participants produce to the public in order to generate revenue to sustain its charitable program. ?DC Social Innovation Project, which helps launch innovative community initiatives, also generates revenue by offering basic financial services that help non-profits focus more on their mission instead of administrative tasks.

For-profit businesses can also blur the line and adopt some charitable aspects into their work while also boosting their bottom line. Here?s a look at how three different types of for-profit companies are building in social good and how any business can adopt these models.

Tevolution and MyCause Water build social good into their business model by donating a portion of the proceeds from each product sold. The creators of Tevolution wanted to create a healthy and delicious bottled tea that its consumer could enjoy while also making a difference. So for every bottle of tea purchased, $0.25 goes to a non-profit organization. Similarly, MyCause Water ? a maker of great tasting bottled water ? donates $0.05 for each bottle sold. Even if a company can?t quite adopt this model, simply committing to donate a certain amount of its product to a non-profit organization can be beneficial ? like a bakery regularly donating loaves of bread to a shelter on a regular basis. This can in turn generate goodwill for the brand and boost its bottom line.

Service
Palantir is a company creating software that helps companies and organizations make sense of massive amounts of data. It has taken the smart step of creating a team of philanthropy engineers within its company that works pro bono with non-profits on the same ?big data? issues that Palantir?s traditional engineers tackle for its for-profit customers. It is a model that can be adapted to even a small business with just a few employees ? like a design firm could work with non-profit clients pro bono to help them revamp their logo, overhaul their website, or create a new brochure. This could simultaneously provide a great professional development and training opportunity for the employee by presenting a new type of challenge, while also giving the firm an additional way to showcase the range of high-quality work it produces.

SendHub is an application for smartphones that provides a simple way to send group text messages. It uses the ?freemium? model by offering its basic messaging service for free and offering a premium service for a fee to users wanting even more features. While SendHub is in business to generate a profit, it strives for its app to be just as useful for social causes and used by teachers and community organizations to share critical information. Thus it shows how a for-profit company can build something equally beneficial to businesses and non-profits alike ? and with a great product the non-profit may become a paying customer for the premium service.

With these models as guides, beyond the legal and tax implications, the choice between starting a non-profit or a for-profit need not be an agonizing one for the social entrepreneur since both types of entities can draw on elements of the other. And even existing companies and non-profits can use these examples as a model to blend profit or purpose into their work.

What's a filibuster look like? Not Jimmy Stewart

The Senate has approved a bipartisan agreement to limit the use of filibusters during debate and to speed nominations.

These days, the simple threat of a filibuster shuts down the Senate.

From Jimmy Stewart's fictional all-night talkathon to real-life dramas over World War I and civil rights, the Senate's filibuster has played a notable ? sometimes reviled ? role in the nation's history. Now the slow-moving, famously deliberative chamber has dialed it back, though modestly.

Filibusters are procedural delays that outnumbered lawmakers use to try killing bills and nominations. But they seldom look like the speech delivered by the exhausted, devoted senator portrayed by Stewart in the film, "Mr. Smith Goes to Washington."

In fact, the Senate currently has more filibusters than ever. But you'd hardly know it by watching the chamber on C-SPAN television.

These days, lawmakers intent on killing a bill simply inform majority Democrats that to pass the measure, they will need yes votes from 60 of the 100 senators. With Democrats controlling just 55 votes, nothing can pass that threshold without at least some Republican support.

And that has brought the Senate virtually to a standstill on a list of sweeping legislation, from tax hikes on the wealthy to limits on greenhouse gas emissions. The resulting gridlock helped inspire recession-weary Americans to slap the last Congress with some of the lowest approval ratings in history.

The Senate late Thursday overwhelmingly approved a bipartisan agreement to limit the use of filibusters when the chamber begins debating a bill and when it wants to try writing compromise legislation with the House. It also will speed approval of some nominations by reducing the amount of debate allowed after the Senate has voted to end a filibuster.

But the pact will still leave the minority party other opportunities on every bill to force majorities to get 60 votes to prevail. Still, the changes will clear the way for other legislation, like a $50.5 billion emergency relief measure for Superstorm Sandy victims that the Senate plans to approve Monday.

Defenders of filibusters say the enormous power it gives to the minority party is what differentiates the Senate from the House, where rules give almost absolute power to the majority party when it remains united.

Opponents say the practice makes a mockery of the concept of majority rule. Democrats say today's Republicans use the tactic far too often, while GOP senators insist they employ it so frequently because today's Democratic leaders block them from offering amendments.

Numbers compiled by the Senate Historian's Office underscore how the practice has grown.

There were 73 votes to end filibusters ? called "cloture votes" ? in the two-year Congress that ended early this month. There were 91 cloture votes in the Congress that ran from 2009 to 2011, and 112 in the Congress that last from 2007 to 2009. Republicans were in the Senate minority for all of those years.

S&P rises for seventh day but 1,500 too steep a climb

NEW YORK (Reuters) - The smallest of gains gave the Standard & Poor's 500 its seventh straight winning day on Thursday, but the index failed to hold above the 1,500 line, restrained by Apple's worst day in more than four years.

Apple Inc slid 12.4 percent to $450.50 a day after it posted revenue that missed Wall Street's forecast as iPhone sales were poorer than expected.

The sharp drop wiped out nearly $60 billion in Apple's market capitalization to less than $423 billion, leaving the company vulnerable to losing its status as the most valuable U.S. company to second-place ExxonMobil , at $416.5 billion.

The S&P 500, however, managed to hit its longest winning streak since October 2006.

"The market has sent the message it is no longer driven by the whims of Apple," said Ken Polcari, director of the NYSE floor division at O'Neil Securities in New York.

The S&P 500 briefly traded above 1,500 for the first time since December 12, 2007, but failed to hold above it, indicating that momentum is waning and a pullback is in the charts.

"If the market had a little bit more excitement to it, momentum players would have jumped after it broke through 1,500. Investors know the market is a little bit ahead of itself," Polcari said.

Economic data helped buoy equities as U.S. factory activity grew the most in nearly two years in January and new claims for jobless benefits dropped to a five-year low last week, giving surprisingly strong signals on the economy's pulse.

At the same time, Chinese manufacturing grew this month at the fastest pace in about two years, while data suggesting German growth picked up boosted hopes for a euro-zone recovery.

"PMI in Asia, Europe, and obviously, here in the United States, is moving in the right direction, and that's stuff people should be excited about," Polcari said.

The Dow Jones industrial average <.dji> rose 46 points or 0.33 percent, to 13,825.33 at the close. The S&P 500 <.spx> inched up just 0.01 of a point, or 0 percent, to finish at 1,494.82. The Nasdaq Composite <.ixic> dropped 23.29 points or 0.74 percent, to end at 3,130.38, with most of that loss on Apple's slide.

The broader Russell 2000 index <.rut> also hit a milestone as it closed above 900 points for the first time.

Video streaming service Netflix Inc surprised Wall Street with a quarterly profit after it added nearly 4 million customers in the United States and abroad. Netflix shares surged 42.2 percent to $146.86, its biggest percentage jump ever.

Earnings have helped drive the stock market's recent rally. Thomson Reuters data through early Thursday showed that of the 133 S&P 500 companies that have reported earnings so far, 66.9 percent have exceeded expectations - above the 65 percent average over the past four quarters.

About 6.8 billion shares changed hands on the New York Stock Exchange, the Nasdaq and NYSE MKT, below the daily average during January 2012 of about 6.93 billion shares.

Roughly five issues rose for every four that fell on both the NYSE and Nasdaq.

Palestinian president wants Israelis to talk peace

RAMALLAH, West Bank (AP) ? The Palestinian president will invite Israeli politicians to the West Bank to try to make sure peacemaking is on the new government's agenda, a senior official said Thursday, even as a top Israeli hard-liner proposed sidelining the polarizing issue.

Hoping to capitalize on the unexpected strength of moderates in Israel's incoming parliament, Palestinian President Mahmoud Abbas wants to sit down with representatives of Israeli parliamentary factions to discuss the possibility of settling the Israeli-Palestinian conflict peacefully, senior Palestinian official Yasser Abed Rabbo told The Associated Press.

"We invite the Israeli parties, particularly the new ones, for dialogue on future accords," Abed Rabbo said.

He did not say when the invitations would go out, but emphasized that Abbas wanted the meeting to take place before Israel forms its next government ? a process that is expected to take several weeks.

Tuesday's parliamentary vote ended in a surprise deadlock between a hawkish, religious bloc and a camp of centrist, secular and Arab parties. While Benjamin Netanyahu, as head of the largest single party in parliament, appears set to remain prime minister, he can't put together a stable coalition without drawing in moderates beyond his traditional hardline and religious base.

He has already extended his hand to a new centrist party that advocates more serious efforts to end the decades-old Israeli-Palestinian conflict.

Peace talks reached an impasse before Netanyahu came into office four years ago and never resumed in earnest. The main obstacle during his tenure has been continued construction of Jewish settlements in areas captured in the 1967 war, the West Bank and east Jerusalem. Israel pulled out of the Gaza Strip in 2005 but still controls access by land, sea and air.

Abed Rabbo said the Palestinians have not dropped two longstanding conditions for negotiations ? Israel must stop settlement building and the contours of the Palestinian state must be negotiated on the basis of the borders Israel held before 1967.

While opinion polls indicate a majority of Israelis back the establishment of a Palestinian state alongside Israel, peacemaking was barely mentioned as a campaign issue, reflecting widespread doubts that peace is possible after decades of violence and stop-and-go talks.

Still, the election's outcome defied forecasts that Netanyahu and his allies would steer a government with an even more hard-line makeup.

Instead, his top partner is likely to be Yesh Atid, a new party with moderate views on peacemaking that has emerged as Israel's new power broker.

Yesh Atid's leader, political newcomer Yair Lapid, has said he will not sit in a government that is not seriously pursuing peace with the Palestinians. But the focus of his campaign has been mostly on helping the needs of Israel's struggling middle class, raising questions about how hard he will push on the peace issue.

Lawmaker Avigdor Lieberman, a Netanyahu ally, told Israel Radio on Thursday that the next government must focus on domestic issues rather than peacemaking to avoid political paralysis, given lawmakers' sharply divergent views.

"If we want to founder from the outset, and embark upon endless internal struggles, then make foreign policy the top priority," he said.

"If we want the government to be effective and accomplish things, and leave a strong, significant imprint, I think everyone understands the need for domestic changes is dramatic, and that is the order of the day. So leave the foreign issues aside," he said.

Netanyahu has hinted that is the direction he is going in through the two brief statements he has given since the election results came in late Tuesday. Both statements have focused on the need to build a broad coalition to address pressing domestic issues.

Lieberman's ultranationalist Yisrael Beitenu party teamed up on a joint list with Netanyahu's Likud for Tuesday's election.

INDEMNIFICATION PROVISIONS IN RIGHT OF WAY AGREEMENTS

Easement agreements are used to address a wide array of issues and interests of landowners including resolving property disputes, clarifying property rights between neighbors or granting new rights of access. Common to all however, is the fact that one person's land will be used by another party or person or sometimes many parties and persons. Right of way agreements that allow others to pass and repass over the land of another often raise questions about the liability of the landowner for loss or injury occurring to the easement holder or third parties who might use the easement-whether with permission or without. What then are the essential duties involved in this relationship and what can be done to mitigate exposure to landowners? As we will see, the relationship between the landowner (the owner of the servient estate) and the easement holder (the owner of the dominant estate) and various third parties is governed by competing legal propositions.

Commonly, the duty of maintaining an easement in such condition and repair as may be necessary to its exercise normally rests upon the holder of the easement. See Shapiro v. Burton, 23 Mass. App. Ct. 327 (1987), citing New York Cent. R.R. v. Ayer, 242 Mass. 69, 75 (1922). As a consequence, the landowner does not have a duty to repair or maintain the easement area. But what if the owner of the servient estate chooses for his own purposes to modify the easement in some way, such as resurfacing or changing the grade? In that instance, the owner of the servient estate must, as to new and different constructions, himself maintain the way so as to be equally safe and suitable for passage as was the way when originally created. See New York Cent. R.R. v. Ayer, 242 Mass. at 75. Thus in the absence of a fixed obligation to repair or maintain as fixed by an express easement, the law implies the obligations and duties as between the easement holder and the land owner.

But what of the duty owed to third parties who find their way to a road or passageway? What duties are owed to such persons by the land owner for defects in the way or injuries incurred in the use of the way? As a general proposition, all landowners in the Commonwealth owe a duty of reasonable care (negligence standard) for the safety of all lawful entrants upon their property as well as certain foreseeable child trespassers and trespassers who are known to be in a position of peril. See Schofield v. Merrill, 386 Mass. 244, 245-46 (1988). The rule is different for an adult trespasser, who as an entrant without consent or invitation, is entitled to no greater duty of care than that the landowner refrain from wilful and reckless disregard for the entrant's safety. Id. This duty of reasonable care then seems to conflict with the obligation of the easement holder to maintain and repair the right of way.

In the absence of an express easement that provides for the allocation of responsibility for such third persons, parties will have to rely on finding which party, landowner or easement holder, is responsible for maintenance and repair and use that duty to set the obligation toward third persons. Yet in drafting express easements, the parties often seek to allocate the risks and responsibilities to third parties through insurance and indemnification provisions. Thus easement holders are often required to provide a minimum level of general liability insurance coverage and name the landowner as an additional insured. As additional protection for landowner, the easement holder is often required to indemnify and hold the landowner harmless from liability associated with the use of the easement.

Recently, we have been involved in a number of easement negotiations that have highlighted the varying levels of protection afforded by indemnification agreements and the efforts by each party to allocate risk. Most indemnification agreements start with similar language. The easement holder is required to

indemnify and hold harmless [Landowner] from and against all claims, demands, suits, costs, expenses, liabilities, fines, penalties, losses, damages and injury to person, property or otherwise, including, without limitation, direct, indirect and consequential damages, court costs and reasonable attorney's fees, arising from or in any respect related to any exercise of or use of the Easement by the [Easment Holder], and their guests and invitees [and others depending on the circumstances] except . . . .

Typically however, an easement holder will seek to limit the extent of their exposure by excepting from the indemnity provision the conduct or acts by the landowner. Two exceptions are frequently offered up, one which excepts both negligent and willful and intentional acts of the landowner and the other that excepts only willful and intentional acts. The typical provisions are as follows:

Excepting Negligent and Intentional Acts: except such injury, loss or damage as shall have been caused by the negligence or willful act of the indemnified party, its agents, guests, invitees, family members or employees.

Excepting Intentional Acts: except such injury, loss or damage as shall have been caused by the willful or intentional act of the indemnified party, its agents, guests, invitees, family members or employees.

Careful thought must be given to these two alternative exceptions and how they relate to the expected use of the property and, more importantly, what level of protection is truly afforded. When an easement holder offers up an indemnity provision but demands that the negligent and willful acts of the landowner be excepted, what real protection is provided? Since the landowner owed a duty of care to all lawful entrants to his property, the exception of negligence from an indemnity clause means that the easement holder is providing highly limited protection to the landowner, akin to indemnity for strict liability. Strict liability without regard to negligence or fault exists in this Commonwealth where unusual and extraordinary uses of land which are so fraught with peril to others that the owner should not be permitted to adopt them for his own purposes without absolutely protecting his neighbors from injury or loss by reason of the use. See Clark-Aiken Co. v. Cromwell-Wright Co., Inc., 367 Mass. 70, 83-85 (1975).

On the other hand, when the easement holder provides indemnification for the negligent acts of the landowner, it usually reflects the fact that the easement holder and not the landowner will be responsible for maintenance and repair and so helps insulate the landowner from the claims of third parties who seek to rely on doctrines of premises liability in the usual shot gun approach to liability. Of course the interplay between indemnity and insurance coverage can be complex and landowners and easement holders alike should seek out competent and experienced legal counsel to help draft express easements. After all, such agreements usually involve appurtenant rights that run with the land in perpetuity and so demand rigorous planning and forethought.

Groupon pulls gun deals from site

In the weeks since one of the worst school shootings in U.S. history at Sandy Hook Elementary, another company is facing pressure and rethinking its approach on guns.

Groupon is reevaluating its gun policies after removing all existing and upcoming deals on guns, shooting ranges and other gun-related offers. The popular online coupon site made the decision following the Newtown, Conn., school massacre where a gunman opened fire killing 20 children and six adults in December.

"Groupon has been testing firearm-related deals like shooting ranges and concealed weapons courses for the last eight months," said Groupon spokeswoman Julie Mossler in a statement. "Based on performance and customer feedback, it's clear they're not a fit right now."

Groupon told Chicago Tribune it has "canceled existing and planned discounts for shooting ranges, conceal-and-carry and clay shooting."

That is exactly what happened to Michael Cargill, owner of Central Texas Gun Works in Austin, who partnered with Groupon to offer a two-for-one concealed handgun licensed course discounted at $69. The regular course fee is $140. The deal was scheduled to run for a week starting on Jan. 15 but was cancelled after a Groupon representative broke the news to Cargill just days later.

"I was furious," said Cargill. "My customers could not sign up for the deal. They called requesting that deal and then they were told by Groupon they could not purchase the deal because Groupon said they weren't doing anymore gun deals at all."

Cargill is now calling on his "Second Amendment family" for an all-out boycott of the popular online deals website. He shared the boycott announcement through social media and also distributed a statement to "members in the gun community."

"I'm calling on every American who believes in the right of safe, lawful gun ownership to join me in refusing to hand over even one red cent to an organization who has no respect for recreational or personal protection who choose to exercise their constitutional right," he said.

Groupon has not contacted Cargill following the boycott announcement. Cargill has not decided whether to seek legal action against Groupon.

Since its launch in 2008, Groupon has become a popular deal curator among tourists and big city natives alike for offers, bargain deals and according to its website, "the best stuff to eat, see, do and buy." Groupon is available in 48 countries worldwide.

Asphodel Meadows

Two otherworldly creatures have their eyes set on Earth. One wants to use Earth like a farm for its army, the other is curious about the life on Earth. They've warred over the control of Earth, but neither has won. After much deliberation, they created a game where the people of Earth decide whom will control the fate of Earth. This game takes place in Port City, a bustling metropolis on an island. The participants in this game are Chosen Ones, people who are given gifts and partners and are able to enter the war in a separate dimension called Asphodel Meadows, which takes place in the mind of the Dreamer.

Port City

In Asphodel Meadows, the world is warped, odd... strange. Those who enter cannot stay for long before they become a piece of the fabric of the dream world. To end the existence of the Meadows, the Chosen Ones must find the Dreamer and end the dream. The fate of Earth depends on it. But the Dreamer has the power to create and the creations aim to protect the Dreamer from anything.

Port City: Asphodel Meadows

Still, even to gain entry to the world, the Chosen One must follow one of the two creatures. The followers of Nyarlahotep, who wishes to farm Earth, are one team. The followers of Demiritashotep, who is curious about the life on Earth, is the other. Whichever team reaches the Dreamer first is the team whose leader has won.

That's where you come in. What is the fate of life on Earth? Will we be farmed like cattle and used as food? Or will we be at the whim of a curious overseer? Pick a side, pick a partner... and join the game.


Rules

So if you visit the page for Asphodel Meadows, there's like, a million rules. It seems like a lot... but they're mostly just guidelines. I actually don't expect most people to read more than just the general rules, which I'm posting here! The remaining rules are there mostly so that when something goes wrong I can point you to the front page. It's just that I can see tons of places where this can go horribly wrong and I'm trying to circumvent that before the roleplay begins.

Sirius is the judge/quest giver in-game, as well as the character who will remove your character from the game (usually) via death.

General Rules

-No Godmoding. You get one warning in game from Sirius and one warning in the OOC and then you're out of the game.

-You can have more than one character. I might ask you to wait, especially if we have a lot of characters, but that doesn't mean you can't have them. If you create a profile and I agree to create your character but we have too many characters playing at the moment, I'll probably wait about a week before letting your new character play.

-Romance is allowed, but it's not the forefront so please obey the rules of the site on that one as far as what you can post is concerned.

-There is a high school in Port City. If your character goes there, that's fine. However, this is not a high school roleplay, so there is probably not going to to be anything worth discussing at the highschool. Therefore, I request that you timeskip over high school activities if you are going to use them.

-Sirius will appear to you to answer questions if you have them and you don't want to go to the OOC, but you can't fight Sirius. So please, no calling Sirius out to fight.

-Cursing? Totally allowed. I ask that you don't just spend an entire post cursing up a storm unless it's absolutely necessary for your character to do so, though.

-Please, please, please read posts before yours carefully. It doesn't have to be EVERY post before yours because I understand that's difficult. Do try to carefully read at least the ones that have to do with your character, though.

-I don't have a limit on your posts, but... I don't like horrendous grammar. So please try to have good grammar, thank you very much. Spelling I can handle to an extent. I don't want to say you need to be "semi-literate", because that seems more like a question of whether or not you're able to read. I'm asking that you use proper language. If you're not a Native English speaker, that's fine. But you'll have to let me know beforehand that you're not native-speaking.

-Even though there's no limit on your posts, please don't rapid fire one sentence responses. It's fine if it's a few times, but if all of your posts are one liners, it gets kind of annoying for everyone else. If people start complaining about it, I might ask you to clarify.

-As far as time is concerned... your character has to leave Asphodel Meadows every now and then. I'd say... for the beginning of this roleplay, anyway... If your character isn't fighting someone but uses their lowest powered spell five times, then they can't use their spells anymore. In a battle, it can be more than that, but your character has to rest after a battle. So, if you're in a battle that occurs and you fight a ton, you should probably stay out of Asphodel Meadows for a few posts. Sirius will eventually power up your character/this will change if we end up with problems, so don't start thinking I'm trying to restrict how much happens in Asphodel.

-Outside of Asphodel, your character has a job and a family. It's not necessary to talk about it (see the high school rule above), but you can use the outer world for planning and sabotage and things like that. I'm trying to say there's action everywhere, not just in Asphodel.

-I will warn you when you're treading on the rules (and you only have two warnings), but I will remove warnings. When I do that, have your character give Sirius a piece of candy in-game. Random gifts of candy to Sirius when you aren't in trouble are fine too, but I probably will check in-game rather than the OOC when I'm just quickly looking over the game.


Characters

Human characters in this game have partners who share their bodies until the human enters Asphodel Meadows. Therefore, on this page I'll list characters, partners, and also the Gift given to the character. But there are none right now.
